Quick Hitter: DFARS Part 250

Just as with my Quick Hitters on the FAR and GSAR, my Quick Hitter series on the DFARS is meant to simplify contracting business with the government. This time with DoD.

DFARS 250.1 Extraordinary Contract Actions

DFARS 250.102-1 Delegation Of Authority

The HCA approves contract actions exceeding $90,000 or more, and the USD A&S in conjunction with the corresponding Under Secretary of Defense and appropriate military secretary selects to exercise the opportunity to compensate the contractor for hazardous materials or nuclear risks.

DFARS 250.102-1-70 Delegations

The various military departments will designate levels of authority. Agencies can redelegate levels of authority previously established by federal regulations and agency supplements as authorized by the director of the defense agency. Requests must be made through the USD A&S and decided on in writing by the agency director or the Department Secretary.

DFARS 250.102-2 Contract Adjustment Boards

All three military departments have constructed a board. It consists of between 2-6 members with a chair and vice chair where a quorum must be necessary to vote, and majority rules the motion. Alternates may be appointed.

DFARS 250.103-3 Contract Adjustments

Requests must be made with the warranted Contract Officer who is signing the action if practical.

DFARS 250.103-5 Processing Cases

The filing activity has 30 days after the close of the month the action was filed (at most 2 months) to submit the record to the appropriate official. The record is forwarded to the contract adjustment board who will expedite decisions as feasible. The chair’s signature constitutes a final decision.

DFARS 250.104-3-70 Indemnification On Contracts Involving R&D And Other Work

The layers of review can be arduous to both COs and contractors. Howeber, the end result guarantees a thorough examination. From delegation of authority, to various boards and processing cases the government routinely ensures that multiple sets of eyes are put on a single action to ensure that proper protocol is followed. I will admit, sometimes such maybe a “dog and pony show”. Nevertheless, ethical decisions make up the majority.
