Just as with my Quick Hitters on the FAR and GSAR, my Quick Hitter series on the DFARS is meant to simplify contract business with the government. This time with DoD.
DFARS 246.470 Government Contract Quality Assurance Actions
DFARS 246.470-1 Assessment Of Additional Costs
Governed by FAR 52.246-2 additional costs may be reimbursed to the contractor. The Quality Assurance Representative (QAR) investigates the matter and relays the findings to the Contracting Officer (CO). Delay, inspection or retest may result in additional costs paid to the contractor by the government. The CO considers the frequency and repetitive nature of said instances upon past and current contracts and the expenditures of addressing the additional costs.
DFARS 246.470-2 Quality Evaluation Data
Quality evaluation data is considered quality data produced by the contractor in accordance with performance, govern data produced by way of inspection(s) and reports submitted by users and customers per this subpart’s PGI.
Our nations government is a stickler for two things; 1). quality work, and 2). making finances whole. They go to paint staking detail to ensure both instances are current and accurate. And very few cases is a courtroom actually necessary.
Personally, I had an experience where a hospital was using one of my base contracts to order a medical service provider. They settled on a contractor who said they had people who could do what they wanted, but it wasn’t the job title that was specified in the solicitation. The government hospital used the contractor suggestion and overpaid in accordance with the job title provided by the contractor. Both sides had lawyers present, but the only thing it took to settle the matter was a phone call and appropriate monies were exchanged due to the government’s mistake while the job was re-solicited because of the CO’s error that was blatantly made due to what they referred to as a “time crunch”. Just as I aimed to make things right when I was a CO, your CO from DoD will make sure quality and finances are both observed and corrected. Because it’s their job.
