Just as with my Quick Hitters on the FAR and GSAR, my Quick Hitter series on the DFARS is meant to simplify contracting business with the government. This time with DoD.

DFARS 239.76 Cloud Computing

DFARS 239.7602 Policy & Responsibilities

Your CO must, at the very least, incorporate standard commercial terms and conditions such as licenses, agreements and terms of service (DFARS 239.7602-1(a). In accordance with DFARS 239.76002-1(b)(1) the CO must procure from the list of vendors compiled by the Defense Information Systems Agency. Exceptions follow in b2 of the same section. Whereas c authorizes the government to specify usage and monitoring specifications.

DFARS 239.7602-2 Required Storage Of Data Within The United States & Its Outlying Areas

Cloud services in all 50 states and territories must house all government data not currently located on the premises of DoD property unless otherwise authorized. The CO will provide written permission for the contractor to house physical data OCONUS.

DoD is known throughout the world for both integrating modern technology and inventing their own to accomplish its mission. Cloud computing is just another recent example of this.

I want to make it abundantly clear that I have never awarded such a contract. However, contracting is contracting is contracting.
