Quick Hitter: DFARS Part 204

Just as with my Quick Hitter series on the FAR and GSAR, my Quick Hitter series on the DFARS is meant to simplify contracting business with the government. This time with DoD.

DFARS 204.403 Responsibilities Of Contracting Officers

Our national government goes to great lengths to protect industry’s proprietary information. As you will find out, it takes both sides working together to harness such intelligence, and otherwise not allow powerful information to be obtained by people, groups and countries who may be considered a threat to our own national security.

Cos in DoD must abide by this insert when they are drafting their solicitation to keep information where it belongs for safe keeping and a trusted business partnership. The guidance located inside does not apply to the intelligence community or purchases within the nuclear arena. Buys are not restricted to foreign relations only, but the level of security clearance required by the contractor necessary for the offeror to submit a proposal and perform upon the decision to award.

notice to industry will encompass one, some or all of the DD 254 (Facility Security Clearance), FAR 52.204-2, NISPOM guidance making clear the process to access various types of information through diverse channels (contractor’s security clearance and what types of information can be accessed) and/or Fundamental Research Project Determination (DFARS 252.204-7000 which governs release of information).

We had an awesome woman for an instructor at the VA Acquisition Academy who I am calling “The Queen Of DoD”. Not only does she know everybody on a first name basis and everybody knows her that way, but she contracted directly to the warfighter in Saudi Arabia during Operation Iraqi Freedom to cap off a well respected career in federal contracting! People like her refer to DFARS 252.204-7000 simply as “7000”, and she had ridiculously cool stories about people releasing things that they shouldn’t have.

Although my direct experience is not within the Department of Defense, I can help you write a proposal because my training taught me that contracting is contracting. I wasn’t lying about being trained by the elite.
