Quick Hitter: GSAR Part 528

Just as with my Quick Hitter series on the FAR, my Quick Hitter series on the GSAR is meant to simplify contracting business with the government. This time with GSA.

GSAR 528.203-7 Exclusion Of Individual Sureties

A surety is basically financial backing in case the construction company is unable to finish a project )they are routinely paired with performance bonds) and ensure the government gets their money.

Now that you know what one is, you can now know what excludes individuals from providing one to your CO on a GSA construction contract.

GSA executives don’t allow single individuals to provide sureties. It must be a business or insurance agency.

To refer for exclusion, the CO must abide by FAR 28.203-5 because at the time of this writeup their is no FAR 28.203-7 as prescribed in the GSAR.

Individuals are excluded due to the inability to make up the difference to the government if the construction company scraps the build, failure to abide by the surety agreement, they misrepresented their individual net worth and their signature was forged by the construction company. If the CO allows for such then they may lose their warrant. Any individual or company must be entered in SAM as an exclusion. This means they cannot be used as brokering a surety or as a construction contractor on a government contract because they committed forgery.

The CO must provide a basis for exclusion (see above paragraph(, a statement of facts, copies of evidence, the person’s name and all known full addresses, any history with GSA, known criminal history complete with court proceedings and an OGC review.

Construction contracts are something I hope to learn during this consulting endeavor. If my second cousin James Duke and his wife can accomplish the feet then I am positive that I can as well.
