Just as with my Quick Hitter series on the FAR, my Quick Hitter series on the GSAR is meant to simplify contracting business with the government. This time with GSA.

GSAR 512.302 Tailoring Of Provisions And Clauses For The Acquisition Of Commercial Products And Commercial Services

Clauses and provisions can and should be tailored to closely match the stipulations of a buy in the commercial sector. This is a common way that the government works hand in hand with industry.

GSA has its hands in a lot of cookie jars.

Here’s how they change contract language and its not cheating.

The supervisor of the CO approves tailored language on an individual contract and on a class of contracts, like schedules, the Director approves the tailored language.

There is one caveat. GSAR 552.212-4(w) can in no way be changed.

So, I want no talk of the government strong arming companies in terms of rules. As far as pricing goes, the market inside the government dictates the prices.

There are no secrets.

A similar process is also how the government negotiates a warranty and return goods policy for contracts consisting of commercial goods. I did that for about three (3) years and understand the government‘s language regarding a warranty and what they look for concerning a return goods policy.
