Quick Hitter: GSAR Part 503

Just as with my Quick Hitter series on the FAR, my QuickHitter series on the GSAR is meant to simplify doing business with the government. This time with GSA.

GSAR 503.104-7 Violations Or Possible Violations

The Head of Contracting Authority is to be notified of any conflicts of interest or other violations. They will be notified if any potential or direct violations which do or do not directly effect a procurement.

The HCA will then notify the Inspector General, determine what to do with the procurement and decide whether the administrator must award the action or move forward with no intent to award.

If the action has not been reassigned then the Director of Contracting takes responsibility for the contracting action.

I can share through experience as the VA’s FSS program is a gift from GSA that this portion of the GSAR is blatantly ignored due to the girth of the medical schedules program negatively proportioned to the low number of employees. Whereas, those who contract the correct way are thrown by the wayside while those that upkeep the system of clerking remain in their seat. Partisan politics is also favored. There’s also regular conversations about personnel receiving “gifts” from contractors. There is also been conversation about a supervisor keeping a gun and they’re filing cabinet because they don’t trust the security guard operation in the building. No information from an IG investigation has ever been shared to my knowledge.
