This series of FAR summaries is meant to take a meaningful portion of the Federal Acquisition Regulations to ensure an easy-to-understand approach so that readers comprehend the process of doing business with the government and that the government exercises a fair and reasonable approach to doing business with the general public.
FAR Part 52
There are 2,495 digital pages of legally binding language which reinforce their specific regulation(s) located in all 51 parts of the FAR.
I’m not sure I want to summarize them all, but I will share with you the difference between a provision and a clause, what they are, how they’re numbered and how they can be used.
FAR 52.1 shows you how clauses and provisions are numbered and how to use them.
The first number corresponds to the specific agency acquisition and the second set corresponds to a specific part in said agency regulation. A third number announces a subset within a specific part of an agency regulation.
Provisions and clauses are different and the word “clause” is not and should not be used interchangeably with the word “provision”.
Your Contracting Officer chooses what and how many of each to add depending on what they are buying. It’s your job to do what they say.
If a contract goes to court, it is the provisions and clauses that legally bind the way the government purchase is supposed to work. The CO needs to know why they picked them and the contractor needs to know what they mean.
